Terms of Service

Montana (“the app”, “the service”, “we”, “us”) is an AI-assisted nutrition and fitness coaching app operated by Montana, available at montana.fit and as mobile apps. By creating an account or using the service you agree to these terms. Questions: hello@montana.fit.

Montana lets you log food (by text, voice, photo, or barcode), track weight and training, receive AI-generated estimates and coaching, and — if you have one — work with your personal trainer. We aim to keep the service available at all times but do not guarantee uninterrupted access, and we may update or change features as the product evolves.

Montana is not a medical service. Calorie and macro figures, adaptive targets, body-composition estimates, form feedback, and coach answers are estimates and general guidance only — they are not medical, dietetic, or physiotherapy advice. Always consult a qualified professional before making significant changes to your diet or training, especially if you have a medical condition, are pregnant, or have a history of disordered eating. If a feature ever conflicts with advice from your doctor, follow your doctor.

You must be at least 16 to use Montana (18+ for physique-photo features), provide accurate information, and keep your login details secure. You are responsible for activity on your account. We may suspend or close accounts that break these terms or abuse the service.

Client accounts are free and are created through a trainer’s invite link. Your trainer can see the data you log in order to coach you — see the Privacy Policy for details and how to change this. (A standalone personal version without a coach may be offered in future.)

Trainers are independent professionals, not employees or agents of Montana. The coaching relationship — including the quality, safety, and suitability of any advice or programming a trainer provides — is between the trainer and their client. Trainers are responsible for holding appropriate qualifications and insurance for the services they offer.

You keep ownership of everything you upload (meals, photos, videos, messages). You grant us the limited licence needed to store, process, and display that content to operate the service — including sending relevant content to our AI providers to generate the estimates and feedback you request. See the Privacy Policy for how content is stored and protected. Don’t upload content that is unlawful, infringes others’ rights, or includes other people without their permission.

Don’t misuse the service: no attempting to breach security or access others’ data, no reverse-engineering, scraping, or reselling the service, no using the AI features to generate unlawful or harmful content, and no interfering with other users. We may suspend accounts that do.

Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or your statutory consumer rights). Subject to that: the service is provided “as is”; we are not liable for losses caused by inaccurate AI estimates, training decisions you or your trainer make, or events outside our reasonable control; and our total liability to a subscribed trainer in any 12-month period is limited to the subscription fees paid in that period.

You can stop using Montana and delete your account at any time (in-app, or by emailing us). We can terminate or suspend accounts that materially breach these terms. On deletion, your data is removed as described in the Privacy Policy.

We may update these terms as the service evolves. For material changes we’ll give reasonable notice (e.g. in-app or by email); continuing to use the service after the change takes effect means you accept the updated terms.

These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you are a consumer you keep any mandatory protections of the law where you live.
